These Terms of Use (“Terms”) govern your access to and use of the ARCH Drafting Company website (“Site”).

By accessing or using this Site, you agree to these Terms. If you do not agree with these Terms, you should not use the Site.

“ARCH Drafting Company”, “we”, “us” and “our” refer to ARCH Drafting Company and its owner, representatives and authorized service providers, as applicable.

1. Purpose of This Website

The Site provides general information about ARCH Drafting Company, our building design, drafting, planning, permit coordination and related pre-construction services, as well as general information concerning design and construction matters.

Information on the Site is provided for general informational and promotional purposes only.

Nothing on this Site constitutes a project-specific design, professional opinion, legal opinion, engineering opinion, zoning opinion, Building Code determination or guarantee of approval.

2. No Designer-Client Relationship

Accessing this Site, contacting ARCH Drafting Company, submitting an inquiry, requesting a quotation or sending us project information does not, by itself, create a designer-client, consultant-client, professional or contractual relationship.

ARCH Drafting Company will only be retained to provide services when the parties have agreed to the applicable scope and terms of engagement, normally through a written proposal, service agreement, authorization or other written confirmation.

Where there is a conflict between these Terms and an executed project-specific agreement with ARCH Drafting Company, the project-specific agreement will govern with respect to that project.

3. No Guarantee of Permit or Approval

Building, zoning and planning approvals are determined by the applicable municipality, authority having jurisdiction or other approval body.

ARCH Drafting Company does not guarantee that:

• a building permit will be issued;
• a zoning or planning application will be approved;
• a minor variance will be approved;
• a particular project will be permitted on a property;
• an authority will accept a particular interpretation;
• a project will qualify for a specific exemption, variance or alternative solution; or
• an approval will be issued within any particular timeframe.

Feasibility opinions, preliminary reviews and discussions are based on the information reasonably available at the time and may be affected by site conditions, municipal records, zoning provisions, applicable law, agency requirements, title restrictions, easements, existing construction or other factors.

4. Building Code, Zoning and Regulatory Information

Building codes, zoning by-laws, municipal policies, standards, permit requirements and other laws and regulations may change over time and may vary by jurisdiction and property.

Information appearing on this Site should not be relied upon as a substitute for a project-specific review of applicable requirements.

Users are responsible for obtaining appropriate advice before making construction, purchasing, financing, investment or other decisions based upon a proposed development or renovation.

5. Estimates, Pricing and Timelines

Any prices, project costs, permit fees, construction costs, timelines or other estimates appearing on the Site or provided through preliminary website communications are illustrative unless expressly identified otherwise in a written proposal from ARCH Drafting Company.

Actual fees, consultant requirements, municipal charges, project timelines and construction costs depend on the individual project and may change as project information becomes available.

A quotation or proposal is subject to the terms, scope, exclusions and validity period stated within that quotation or proposal.

6. Information You Provide

If you submit information through this Site, you represent that:

• the information you provide is accurate to the best of your knowledge;
• you have the right to provide any documents, drawings, photographs or other materials submitted;
• your submission does not infringe another person’s intellectual property, privacy or other rights; and
• you will not knowingly submit malicious software, unlawful material or misleading information.

You grant ARCH Drafting Company permission to review, store, reproduce internally and share submitted material with its consultants or service providers to the extent reasonably necessary to respond to your inquiry, assess the project or provide services you have requested, subject to our Privacy Policy and any subsequent project agreement.

7. Intellectual Property

Unless otherwise indicated, the Site and its original contents, including text, graphics, layouts, logos, branding, photographs, illustrations, renderings, drawings, design elements and other materials, are owned by or licensed to ARCH Drafting Company and are protected by applicable copyright, trademark and other intellectual property laws.

You may view the Site and may temporarily download or print reasonable portions of its content for your own personal, non-commercial informational use.

Unless you have received prior written permission from ARCH Drafting Company, you may not:

• reproduce, republish or distribute Site content;
• modify or create derivative works from Site content;
• use our drawings, renderings or designs for another project;
• use Site content commercially;
• remove copyright, trademark or proprietary notices;
• represent ARCH Drafting Company content as your own;
• scrape or systematically extract Site content;
• use Site content to train, populate or commercially operate a database, automated system or competing service; or
• mirror substantial portions of the Site on another server or website.

8. Project Drawings and Designs

The presence of project drawings, photographs, renderings or designs on the Site does not grant anyone permission to reproduce or construct from those materials.

Plans and designs are prepared for particular properties, conditions, clients and project requirements and may not be suitable for use elsewhere.

Rights relating to drawings and other deliverables prepared for a client may also be subject to the applicable project agreement.

9. Portfolio and Project Information

Images, renderings and descriptions on the Site may represent proposed, conceptual, permitted, completed or in-progress work.

Renderings and conceptual illustrations are intended to communicate design intent and may differ from final construction.

Construction may also be modified by owners, contractors, consultants, authorities or site conditions after ARCH Drafting Company’s involvement.

10. Accuracy of Website Information

We make reasonable efforts to provide useful and accurate information but do not represent or warrant that all Site content is complete, accurate, current or free from technical, typographical or other errors.

We may modify, correct, remove or update Site content at any time without notice.

We are not obligated to update information merely because requirements or circumstances have subsequently changed.

11. Third-Party Consultants and Services

ARCH Drafting Company may coordinate or refer clients to engineers, surveyors, contractors or other third-party professionals and service providers.

Unless expressly stated otherwise in a project-specific agreement, those third parties are independent from ARCH Drafting Company and are responsible for their own professional services, advice, designs, calculations, workmanship and obligations.

A reference or link to a third party does not constitute a guarantee of that third party’s work or services.

12. Third-Party Websites and Links

The Site may contain links to municipal websites, government resources, social media platforms, consultant websites or other third-party services.

These links are provided for convenience only.

ARCH Drafting Company does not control and is not responsible for the availability, accuracy, content, policies, security or practices of third-party websites. The inclusion of a link does not necessarily constitute an endorsement.

Use of third-party websites is at your own discretion and subject to their terms and policies.

13. Prohibited Uses

You may not use the Site:

• for any unlawful purpose;
• to infringe the rights of ARCH Drafting Company or another person;
• to introduce malicious code or interfere with the Site’s operation;

To the maximum extent permitted by applicable law, ARCH Drafting Company will not be liable for indirect, incidental, special, consequential or similar damages arising from your use of, inability to use or reliance upon this Site or its general informational content.

This includes, without limitation, losses arising from reliance upon preliminary website information concerning zoning, permit requirements, project feasibility, construction costs or timelines.

Any liability arising from professional or project-specific services provided by ARCH Drafting Company is governed by the applicable project agreement and applicable law rather than these website Terms.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

16. Privacy

Your use of this Site is also subject to the ARCH Drafting Company Privacy Policy.

The Privacy Policy explains how we collect, use, disclose and protect personal information provided through the Site and related communications.

17. Changes to the Site or These Terms

We may modify the Site or these Terms periodically.

Updated Terms become effective when posted unless otherwise stated. The effective date shown at the beginning of these Terms indicates the date of the current version.
